    Sen Bayh "uncommitted"

    As we try to count votes on health care legislation, check out the email I just received from my FNC colleague on the hill, Trish Tuner:

    Former governor-turned-senator Bayh says he’s uncommitted on this “opt out” public option.

    Says he likes that there’s “not a one-size-fits-all answer from Washington – that he does “like the fact that the states do have some discretion to allow for their unique circumstances” – but he says “there are a variety of things that i think might work better” (wont say what – but starts to say “trigger”).

    “The question is is this enough flexibility for states to account for their own circumstances. And the answer to that is perhaps. But I’d like to wait to see what’s in the language”.

    Says there are a lot bigger concerns for him -- especially provisions that might “substantially increase the deficit” --- says “I would just have a very hard time supporting something that would do that.”

    Wants to see an independent analysis (CBO).

    Bayh has asked CBO for an analysis of what this means for premiums for people – will the cost of insurance go up? (speaking about the overall reform effort)

    Q: What does this mean for his cloture vote? What have you told Reid?

    Well I told the leader if there are provisions included int his that would dramatically increase the deficit in future years, I would have just a very hard time moving forward (aka: voting for cloture) on something like that. So that really is my primary concern.

    BOTTOM LINE: BAYH IS UNCOMMITTED. HE SAYS “THE DEVIL IS IN THE DETAILS” – AND HE WANTS TO SEE THE DETAILS, BUT THAT THE OVERALL BILL GIVES HIM GREATER HEARTBURN THAN THIS ‘OPT OUT’ PROVISION.

Given that CIA has not changed one iota since the Church Committee revelations of CIA's truly amazing incompetence, it would be easier to count the number of times CIA told the truth to Congress. One should simply assume that CIA is lying any time it says anything (this is especially true about the DCIA).

I demand an apology from everyone out there who questioned Ms. Pelosi's statement that the CIA withheld information. Any Republican sympathizer commenting on this topic must start with such an apology or their comments carry no weight.

Democrats on the Intelligence Committee have concluded that the CIA did not fully inform Congress about the use of enhanced interrogation techniques during a September 2002 briefing. The new report seemingly validates House Speaker Nancy Pelosi's (D-Calif.) claim earlier this year that she was lied to about the program.
